Prints That Sell Website Terms and Conditions of Use

Agreement between Prints That Sell by The Girl That Prints and you covering the use of www.PrintsThatSell.com:

Welcome to www.printsthatsell.com. The www.printsthatsell.com website ("Site") is comprised of various web pages operated by The Girl That Prints ("Prints That Sell"). "www.printsthatsell.com” is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein ("Terms"). Your use of www.printsthatsell.com constitutes your agreement to comply with all such Terms. Please read the Terms carefully, and keep a copy of them for your reference. The Site conveys information about Prints That Sell products, services, and markets. This Site also conveys industry-specific information and educational materials pertaining to the markets Prints That Sell serves.

Free Artwork Policy

If your purchase includes a free design, this will come watermarked with "Designed by printsthatsell.com". Un-watermarked designs can be purchased for it's original value.

Free Print Policy

If your purchase includes a free print, or you receive a free item, this might come watermarked with "Printed by printsthatsell.com". Un-watermarked prints can be purchased for it's original value.

File Preparation/Customer Provided Content

For certain product and service offerings you may elect to electronically upload data, text, photographs, graphics, messages or other materials (collectively, “Customer Content”) to Prints That Sell for inclusion in print products. You understand and agree that you (and any other person from whom it may have originated) are solely responsible for all Customer Content. When you upload, or otherwise provide Customer Content to Prints That Sell you warrant and confirm that you either own the copyright to or have permission to copy any documents, text, graphics, photographs, etc., that you submit for inclusion in the print process, and you agree to defend, indemnify and hold Prints That Sell and its officers, directors, employees, shareholders agent and affiliates, harmless from any suit, demand, or claim arising out of any breach of this warranty and agree to pay any judgment or reasonable settlement offer resulting from any such suit, demand or claim, and to pay any attorney’s fees incurred by Prints That Sell in defending against such suit, demand or claim.

By placing this order I have verified that the spelling and content of my orders are correct and I am satisfied with the document layout. I understand that my document will cut exactly as it appears on the preview minus the standard under-sizing trimming area of proximally 1/16" all around in some products, and the printing in CMYK could vary from how the art looks in my RGB computer monitor. I assume all responsibility for typographical, formatting, and designing errors.

Prints That Sell does not maintain Customer Content indefinitely. Customer Content uploaded to the Website with an associated order will be kept on file for a period of up to fifteen (90) days. At the end of that time it may be deleted and irretrievable. Please note that Customer Content uploaded to Prints That Sell cannot be used to re-order an additional print job; it is only maintained for reprint purposes.

You agree that you will not send, upload, post or otherwise transmit to Prints That Sell any Customer Content that contains material that: (i) is unlawful, threatening, abusive, defamatory, and/or obscene; (ii) which invades another person’s privacy; (iii) which would further the commission or concealment of a crime; (iv) advocates or urges treason, insurrection, sedition or forcible resistance to any law of the United States; (v) is not lawfully yours to transmit; (vi) is the subject of, or which infringes upon, any patent, trademark, trade name, trade secret, copyright, right of publicity, moral right or other intellectual property right of another person or entity; (vii) contains software viruses, trojans, malware, or other harmful or malicious computer code, or that in any other way would way interfere with or disrupt the services and/or production of Prints That Selll and/or or any servers or networks connected to or used in connection with the delivery of such service and production.
You acknowledge that Prints That Sell does not pre-screen Customer Content, but that Prints That Sell reserves the right to do so at any time and that Prints That Sell shall have the right (but not the obligation) in their sole discretion to remove any Customer Content and/or to refuse to fulfill a print job or order that violates these Site Terms or that may otherwise be objectionable. You further acknowledge and agree that Prints That Sell may preserve Customer Content, yet will not disclose Customer Content unless required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with the legal process; (b) enforce these Site Terms; (c) respond to claims that the Customer Content violates the rights of third-parties; or (d) protect the rights, property, or personal safety of Prints That Sell , its employees, users and the public in general.
Regardless of the upload of Customer Content to this Website, and/or the inclusion of Customer Content into any product or service offered through this Website, Prints That Sell, retains all of its rights in and to all Site Content on this Website, whether created by, for or on behalf of Prints That Sell.

Uploaded Content Requirements

We strongly recommend that content uploaded to Prints That Sell for print fulfillment is:
At a minimum of 300 DPI at 1:1 ratio (or 100%). Content that does not meet this standard may experience print or images that are fuzzy, pixilated or otherwise distorted for which Prints That Sell does not accept any responsibility. We reserve the right to reject content that does not meet this standard, but we do not assume any obligation to verify that the content meets this criterion.
Designed in CMYK and uploaded to Prints That Sell in CMYK with no embedded color profile. (You may upload in RGB or some other standard if you choose, however, the color will be converted and Prints That Sell is not responsible for any inaccuracy or color shift that occurs as a result of the conversion).
All print jobs print head to head from the supplied file. This means the top of the front of the file (head) will back up with the top of the back of the file. We are not responsible for jobs that seem to print "upside down" since we cannot judge if the original intent is to print "upside down".
Pricing provided either through a quote or as shown on the website is subject to change after review of print ready files.

Orders are printed in their “as submitted” form and the customer is fully responsible for final proof and layout verification and approval prior to submission to the print process. Prints That Sell does not make any changes on customer files, unless requested however not guaranteed. Once you submit an order to the print process you are agreeing that you are fully satisfied with the document layout and content and you accept responsibility for any errors therein. Prints That Sell will assume that you have verified the spelling, grammar, content and layout, etc. are all correct and it will not accept any liability for errors such as misspelling, grammar, damaged fonts, punctuation, transparency, overprint, improper layout, bleeding, erroneous cut or fold lines, die lines or crop marks, sizing, etc.

Prints That Sell does not provide proofreading of any order unless the customer requests it as part of the order process and it is an option available for the product. If you request a proof then it is your responsibility to verify the proof against the original (and to correct any spelling or grammatical errors, etc).

Printing Turnaround Time

Printing turnaround time begins once your order has been approved for printing. For print jobs that have not met the proper print requirements, turnaround will begin once we have received your print-ready files and the files have been approved. Not at the time, the order was placed.

Production takes 4-7 business days, otherwise stated. This time frame does not include shipping, which takes 2-3 days.

Cancellation Policy

Due to our turnaround times, there is only a 20-minute window to cancel your order. To request cancellation, please email thegirlthatprints@gmail.com along with your order number and subject as: "Cancellation Request". Requests can only be made if order status has not moved into "In Production". Making the request does not guarantee it will be canceled.

Shipping

We currently offer USPS 2-3 Day Priority Mail Shipping. When choosing this option please remember that the estimated shipping transit time is based on the number of business days in transit and does not include weekends nor holidays.

Prints That Sell assumes no responsibility for delays caused by shipping carriers due to weather or any other unforeseen shipping-related situations that may result in your package not arriving on time. Prints That Sell assumes no responsibility and is only responsible for preparing your printing order and handing it off to the carrier at the initially agreed turnaround time.

Prints That Sell is not liable for damages that occur in shipping.

Your Account

Certain services made available via www.PrintsThatSell.com are delivered by third-party sites and organizations. By using any product, service or functionality originating from the Prints That Sell domain, you hereby acknowledge and consent that Prints That Sell may share such information and data with any third-party with whom Prints That Sell has a contractual relationship to provide the requested product, service or functionality on behalf of Prints That Sell users and customers.

Payment

We require each order to be fully paid, including shipping and handling fees, if applicable, before we complete an order. We will not start working on a print job until we receive the full payment.

Once a print job has been approved by the customer and the files are in "Print Production" status, no changes are allowed to the artwork files, job characteristics, or printing turnaround time.

Refund Policy

All sales are final. Since we customize each order according to your file and exact specifications, no refunds are given

If we verify that we have made an error, we will re-run the order. We must be notified within 48 hours from delivery of any defects. In order to receive the replacement, customers must return in full the defective order at their expense within 7 days of their receipt. We will re-run the order with the original turnaround and send them out via the same paid shipping method. Shipping is non-refundable.

In some cases, a partial or full refund may be extended to the customer if no work has been completed by Prints That Sell for a specific order.

Each order made from Prints That Sells a contract between you, as the customer making the order, and Prints That Sell.

Our Sales Tax Policy

If you are tax-exempt, you must submit your reseller’s certificate prior to placing an order. This is only, and only if you are ordering for selling purposes such as apparel. Please send email with proof of exempt to thegirlthatprints@gmail.com along with your order number.

Proofs

No job will be sent to the press without your approval. Once you have approved the proof and submitted your print job, you will be unable to make any further changes. We are not liable for delays in the order caused by the customer's non-approval of the proof.

An online proof is by no means an accurate color reproduction of your final printed piece but is the final opportunity for you to check the layout, bleeds, crops, and final text. Electronic proofs do not show transparency and overprint issues. Neither do they show color change from RGB or Pantone to CMYK.

No Liability for Errors

Prints That Sell is not liable for errors in a final product caused by any of the following reasons:

Misspelling, Graphics, Bleeds, Grammar, Damaged Fonts, Punctuation, Wrong cuts, Incorrect or Missing Folds, Die Lines, Crop Marks, Transparency, Overprint, Cracks on Folds, Finished Product Size. Prints That Sell do not make any changes on customer files unless requested.

Overprint and Underprint Policy

Due to the gang-run method that Prints That Sell uses on some products, we cannot guarantee that every order will be the exact number of items that are ordered. Prints That Sell only guarantee that it will come within plus or minus 10% of the number of items ordered.

Miscellaneous

All complaints must be registered within 24 hours of receipt of your final printing job. Should your job contain manufacturing errors and/or defects (as determined by Prints That Sell), Prints That Sell would rerun your job at no charge.

All materials we create in producing your printed product are the property of Prints That Sell. Although these materials will NOT be sold or given to any other party, we reserve the right to distribute free samples of your printed product. Please note that your printed product or images used for your printed product will not be used in any national advertising without your prior written consent.
